Terms of Service
These Terms of Service govern your access to and use of ChatSend, including the WhatsApp messaging API, bulk campaign dashboard, contact and group tools, subscription checkout, documentation, and related support.
Effective Date
Last updated: April 14, 2026. By accessing or using ChatSend, you agree to these Terms. If you do not agree, do not use the service.
Service Description
ChatSend provides tools for connecting WhatsApp sessions, sending messages through an API or dashboard, managing contacts and groups, importing campaign audiences, tracking delivery activity, and integrating webhooks into your systems.
ChatSend is not WhatsApp, Meta, or an official WhatsApp Business API provider unless expressly stated in a separate written agreement. Your use of WhatsApp remains subject to WhatsApp and Meta policies.
Accounts and Credentials
- You must provide accurate account information and keep it current.
- You are responsible for maintaining the confidentiality of login credentials, API keys, webhook secrets, connected device access, and WhatsApp session controls.
- You must notify us promptly if you suspect unauthorized access, credential exposure, or misuse of your account.
- We may suspend or restrict accounts that present security, abuse, billing, legal, or platform-integrity risks.
Acceptable Use
- Send messages only to recipients you are allowed to contact and honor opt-out, consent, and applicable messaging requirements.
- Do not use ChatSend for spam, phishing, scams, harassment, hate, threats, illegal content, malware distribution, deceptive impersonation, or unauthorized data collection.
- Do not attempt to bypass rate limits, abuse protections, WhatsApp restrictions, authentication controls, payment checks, or account safeguards.
- Do not reverse engineer, disrupt, overload, scrape, resell, or create competing services from ChatSend except where a written agreement allows it.
- Do not upload or send content that infringes intellectual property, privacy, publicity, contractual, or other third-party rights.
Customer Content and Responsibility
You retain ownership of the contact lists, campaign content, message templates, media references, webhook payloads, and business data you submit to ChatSend. You grant ChatSend the rights needed to host, process, transmit, store, display, troubleshoot, secure, and improve the service.
You are responsible for the legality, accuracy, consent status, and compliance of the messages and recipient data you process through ChatSend.
Plans, Payment, and Cancellation
- Paid plans are billed according to the pricing, billing period, and checkout terms shown when you subscribe.
- Subscription checkout and payment events may be processed by third-party payment providers.
- You are responsible for taxes, fees, and payment details associated with your account unless checkout terms state otherwise.
- Failure to complete payment may result in downgrade, suspension, or loss of access to paid features.
- You may cancel a subscription according to the available account or support flow. Unless required by law or stated in a separate policy, fees already paid are not automatically refundable.
Service Availability and Changes
We work to keep ChatSend reliable, but we do not guarantee uninterrupted, error-free, or perfectly delivered messaging. Availability can be affected by maintenance, provider changes, WhatsApp behavior, account status, rate limits, recipient devices, network conditions, or other factors outside our control.
We may update, limit, suspend, discontinue, or modify features when needed for security, reliability, compliance, provider requirements, product direction, or abuse prevention.
Third-Party Services
ChatSend may depend on third-party services for authentication, hosting, payments, analytics, messaging infrastructure, email, monitoring, or support. We are not responsible for third-party services, policies, outages, account actions, or platform rules outside our control.
Privacy
Our Privacy Policy explains how we collect, use, share, and protect information. By using ChatSend, you also agree to the data practices described in that policy.
Intellectual Property
ChatSend, including its software, interface, documentation, branding, and service design, is owned by ChatSend or its licensors. These Terms do not transfer ownership of ChatSend technology to you.
Termination
You may stop using ChatSend at any time. We may suspend or terminate access if you violate these Terms, create risk for the platform or recipients, fail to pay, misuse connected services, or if continued access would create legal, security, or operational concerns.
After termination, your right to use ChatSend ends immediately. Sections that by their nature should survive termination will continue to apply, including payment obligations, ownership, disclaimers, limitations of liability, indemnity, and dispute-related terms.
Disclaimers
ChatSend is provided on an as-is and as-available basis. To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, and guaranteed messaging outcomes.
Limitation of Liability
To the maximum extent permitted by law, ChatSend will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, lost goodwill, message non-delivery, account restriction, or third-party platform action arising from or related to your use of the service.
Indemnification
You agree to defend, indemnify, and hold harmless ChatSend and its personnel from claims, losses, liabilities, damages, costs, and expenses arising from your use of ChatSend, your customer content, your recipients, your violation of these Terms, or your violation of law or third-party rights.
Governing Law
These Terms are governed by the laws of the United States, without regard to conflict-of-law rules, except where applicable law requires otherwise.
Changes to These Terms
We may update these Terms from time to time. When changes are material, we will take reasonable steps to provide notice. Continued use of ChatSend after updated Terms take effect means you accept the updated Terms.
